GENERAL PROVISIONS
These terms and conditions are valid exclusively between the company LENORI srl Unipersonale, with registered office at Via Vittorio Emanuele Orlando 10 (PG), REA PG - 303481, VAT number 03635880549, hereinafter referred to as "CORSO VINCI", and any person making online purchases on the website www.corsovinci.com, hereinafter referred to as the "CUSTOMER". These terms and conditions may be subject to change; the date of their publication on the website is equivalent to the effective date. These terms and conditions govern purchases made on the website www.corsovinci.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003 regarding e-commerce.
ART.1 - OBJECT OF THE CONTRACT
Under these general conditions of sale, CORSO VINCI sells and the CUSTOMER purchases remotely the tangible personal property listed and offered for sale on the website www.corsovinci.com. The contract is concluded exclusively online, when the CUSTOMER accesses www.corsovinci.com and places a purchase order according to the procedure provided on the website itself. Before confirming their order, the customer undertakes to review these general conditions of sale, in particular the pre-contractual information provided by CORSO VINCI, and to accept them by checking the box provided. In the order confirmation email, the CUSTOMER will also receive a link to download and archive a copy of these general conditions of sale, as required by art. 51, paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
ART.2 - PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER
Art. 49 of Legislative Decree 206/2005. Before concluding the purchase contract, the CUSTOMER must review the characteristics of the goods, which are illustrated in the individual product sheets at the time of selection by the CUSTOMER. Before confirming the order with "obligation to pay," the CUSTOMER is informed of: the total price of the goods including taxes, with details of shipping costs and any other costs; payment methods; the deadline by which CORSO VINCI undertakes to deliver the goods; the conditions, terms, and procedures for exercising the right of withdrawal (Article 6 of these conditions), as well as the standard withdrawal form pursuant to Annex I, Part B of Legislative Decree 21/2014; information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal; the existence of the legal guarantee of conformity for the purchased goods; after-sales assistance conditions and commercial guarantees provided by CORSO VINCI. ART.3 - CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The sales contract is considered concluded when CORSO VINCI sends the CUSTOMER an order confirmation email. The email contains the CUSTOMER's details and order number, the price of the purchased goods, shipping costs, the delivery address to which the goods will be sent, and a link to print and archive a copy of these terms and conditions. The CUSTOMER undertakes to verify the accuracy of the personal data contained in the above email and to promptly notify CORSO VINCI of any corrections/modifications. CORSO VINCI undertakes to describe and present the items sold on the site in the best possible way. However, some errors, inaccuracies, or small differences between the product depicted on the site and the actual product may arise. Furthermore, the photographs of the products presented on www.corsovinci.com do not constitute a contractual element, as they are intended for illustrative purposes only. CORSO VINCI undertakes to deliver the goods within 6 days from the date CORSO VINCI sends the order confirmation email to the CUSTOMER.
ART.4 - PRODUCT AVAILABILITY
Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because: products may be sold to other CUSTOMERS before the order is confirmed; due to the simultaneous presence of multiple users on the site; a computer error may occur that makes a product available for purchase when it is actually unavailable. Even after the order confirmation email has been sent by CORSO VINCI, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected by eliminating the unavailable product(s), and the CUSTOMER will be immediately notified via email; the email will also inform the customer of the methods and timeframe for refunding any amounts paid.
ART.5 - PAYMENT METHODS
All payments by the CUSTOMER may be made exclusively using the credit cards listed on the website www.corsovinci.com, by bank transfer, by PayPal, or by installment payments via financing starting from €200.00. If paying by credit card, the order amount will be charged only when the order is complete and ready for shipment. If paying by PayPal, the amount will be charged when CORSO VINCI sends the order confirmation email. Payments may also be made using Gift Cards and Loyalty Vouchers. Communications relating to payments and the data provided by the CUSTOMER when making the payment are handled via secure lines. The security of credit card payments is guaranteed by VBV (Verified by VISA) and SCM (Mastercard Security Code) certification.
ART.6 - PRICES
All product prices listed on the website www.corsovinci.com are expressed in euros and include VAT and, where applicable, WEEE (Waste Electrical and Electronic Equipment) charges. Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made. The CUSTOMER accepts CORSO VINCI's right to change its prices at any time; however, goods will be invoiced based on the prices listed on the website at the time the order is placed and indicated in the confirmation email sent by CORSO VINCI to the CUSTOMER. In the event of a computer, manual, technical, or any other error that could result in a substantial change, unforeseen by CORSO VINCI, to the retail price, making it exorbitant or clearly negligible, the purchase order will be considered invalid and canceled, and the amount paid by the CUSTOMER will be refunded within 14 days of the cancellation date.
ART.7 - RIGHT OF WITHDRAWAL
In accordance with applicable legal provisions, the CUSTOMER has the right to withdraw from the purchase without penalty, within 14 days of receiving the products. The CUSTOMER wishing to exercise the right of withdrawal must notify CORSO VINCI via an explicit declaration, which can be sent by registered mail or by accessing the My Orders section of the My Corso Vinci Account space on the website www.corsovinci.com, by creating a computerized Return request. The CUSTOMER may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively submit the standard withdrawal form, pursuant to Annex I, Part B, Legislative Decree 21/2014 (not mandatory), the text of which is reproduced below: Standard withdrawal form pursuant to art. 49, paragraph 1, letter h) (complete and return this form only if you wish to withdraw from the contract). I/we (*) hereby notify (*) the withdrawal from my/our (*) contract of sale of the following goods/services (*): Ordered on (*)/received on (*); Name of consumer(s); Address of consumer(s); Signature of consumer(s); (only if this form is sent on paper); Date. In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he/she communicated to CORSO VINCI his/her wish to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005. The goods must be returned to LENORI Srl Via Vittorio Emanuele Orlando 10, 06128 Perugia (PG). The goods must be returned intact, in their original packaging, complete in all their parts (including packaging and any documentation and accessories: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, CORSO VINCI will refund the cost of the returned products within a maximum of 14 days. Regarding the return of the returned product, Corso Vinci guarantees its customers the option of using a carrier affiliated with the company. If the customer decides to use this service, the shipping costs (except those related to telephone reservations) will be borne by Corso Vinci (Article 56, paragraph 1, Legislative Decree 206/2005). If the customer intends to use another carrier or shipping method, all costs will be borne by the customer (Article 56, paragraph 2, Legislative Decree 206/2005). As provided for by Article Pursuant to Article 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, CORSO VINCI may withhold reimbursement until the goods are received or until the CUSTOMER demonstrates that the goods have been returned to CORSO VINCI. CORSO VINCI will process the refund using the same payment method chosen by the CUSTOMER during the purchase process. In the case of payment by bank transfer, and if the CUSTOMER wishes to exercise their right of withdrawal, they must provide CORSO VINCI with their bank details (IBAN, SWIFT, and BIC) by accessing the contact us section. In the event of a return for a purchase made with a gift card or loyalty voucher, the amount will be refunded to the CUSTOMER in the form of a voucher with a promotional code sent to the CUSTOMER's email address. Alternatively, in the event of a return at a point of sale, the amount will be refunded in the form of a voucher delivered to the CUSTOMER. The voucher will be valid for 2 years and can be used by the CUSTOMER for subsequent purchases in a single transaction. *It is understood that in the event of a product defect, shipping costs will in any case be covered by Corso Vinci.
ART.8 - LEGAL GUARANTEE OF CONFORMITY
In the event of receiving defective or otherwise non-compliant products, the CUSTOMER has the right to have the product restored to conformity free of charge by repair or replacement. The CUSTOMER may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to CORSO VINCI within two months of discovery. To exercise this right, the CUSTOMER must create a return request by accessing the "My Orders" section of the "My Account" section online at corsovinci.com. In the event of a defective or non-compliant product, CORSO VINCI will, at its own expense, arrange for the product to be collected, subject to the CUSTOMER's availability.
ART.9 - COMMERCIAL WARRANTY
All products presented on the website www.corsovinci.com benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial guarantee whose duration is stated on the product sheets of the items. To benefit from warranty assistance, the CUSTOMER must keep the invoice, which can be printed by accessing the My Orders section of the My Online Account area.
ART.10 - DELIVERY METHODS
CORSO VINCI will only accept orders for delivery within Italy and the Republic of San Marino. Products will be delivered via express courier to the address indicated by the CUSTOMER when placing the order, no later than 30 days after the CUSTOMER receives the order confirmation email from CORSO VINCI. For each order placed on the website www.corsovinci.com, CORSO VINCI will issue an invoice for the shipped goods. The invoice is available and printable, after the order has been processed, in the My Orders section of the CUSTOMER's My Corso Vinci Account area. The invoice will contain the information provided by the CUSTOMER during the purchase process. Once the invoice has been issued, it will not be possible to make any changes to the information provided.
ART.11 - RESPONSIBILITY
CORSO VINCI assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions or disruptions, in the event that it is unable to fulfill the order within the timeframes stipulated in the contract.
ART.12 - ACCESS TO THE SITE
The CUSTOMER has the right to access the site for browsing and making purchases. Any other use, particularly commercial, of the site or its content is not permitted. All elements of this site, whether audio or visual, and the related technology used remain the property of CORSO VINCI and are protected by intellectual property rights.
ART. 14 - INTEGRACY
These General Conditions of Sale constitute the entirety of the clauses that comprise them. If one or more provisions of these General Conditions of Sale are held to be invalid or declared as such pursuant to law, regulation, or following a decision by a court having jurisdiction, the other provisions will remain in full force and effect.
ART.15 - APPLICABLE LAW AND JURISDICTION
These General Conditions of Sale are governed by Italian law. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the Court of the CUSTOMER's place of residence or domicile, if located within the territory of the State. In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following website: https://webgate.ec.europa.eu/odr.
